Terms of Service

These Terms of Service ("Terms") are a legally binding agreement between you and Rhotak LLC, a Wyoming limited liability company (https://rhotak.com) ("Rhotak", "we", "us"). Rhotak develops and operates Encrypta (encrypta.app).

By visiting encrypta.app, joining the waitlist, or using the application after launch, you agree to these Terms and to our Privacy Policy and Cookie Policy. You must be at least 16 years old to use Encrypta.

Encrypta is a private personal video vault: zero-knowledge, encrypted cloud storage for your personal memories and video journals.

• Web Application: The web application is scheduled for public release in December 2026.
• iOS and Android Apps: Native apps are scheduled to follow soon after the web application launches.

So that unencrypted video never leaves your device:

• In-App Recording Only: All videos in Encrypta must be recorded with the recorder built into the web application (and, later, the iOS and Android apps).
• Encryption as You Record: As video is captured, the Encrypta app encrypts it in memory with authenticated AES-256-GCM before it is saved or uploaded.
• No Imports: Encrypta only stores videos you record inside it. You cannot upload existing video files.

Encrypta's zero-knowledge design gives you complete privacy, but it also makes you solely responsible for your passphrase:

You agree to keep a secure offline backup of your passphrase. Rhotak is not responsible for loss of access caused by a lost or forgotten passphrase.

• Your Videos Are Yours: You keep all intellectual property, copyright, and moral rights in every video you record into your vault.
• Limited Storage Permission: You give Rhotak permission only to store, copy, and transmit your encrypted files as needed to provide Encrypta to you. We claim no other rights in your content and cannot view it.
• Encrypta Brand and Software: The Encrypta name, logo, designs, and software belong to Rhotak and are protected by copyright and trademark law. Encrypta™ is a trademark of Rhotak LLC. These Terms give you no right to use our names, logos, or trademarks without our written permission.

You agree to use Encrypta only for lawful personal or professional recording. You agree not to:

• Record, store, or distribute child sexual abuse material (CSAM) or any content that facilitates violence, terrorism, or other serious illegal harm.
• Record other people without their consent where the law requires it.
• Probe, scan, or attack our systems, or launch denial-of-service attacks against encrypta.app or rhotak.com.
• Reverse-engineer Encrypta for malicious purposes, or use it to distribute malware.

Encrypta is currently in pre-launch, ahead of its scheduled release in December 2026. Joining the waitlist does not guarantee early or priority access.

We may update our infrastructure, improve our encryption, or change planned features and release dates. We do not guarantee that Encrypta will be available without interruption.

• Changes to These Terms: We may update these Terms. We will change the effective date above, and for significant changes we will notify you by email before they take effect. If you keep using Encrypta after that, you accept the updated Terms.
• Leaving Encrypta: You can stop using Encrypta and delete your vault at any time.
• Suspension: We may suspend or close accounts that break these Terms or when the law requires it.

To the maximum extent permitted by law, Rhotak and its founders, directors, employees, and partners are not liable for any indirect, incidental, punitive, or consequential damages, including loss of access caused by a lost passphrase, hardware failure, or a compromised device.

Nothing in these Terms limits liability that cannot be limited by law, or removes rights you have under the mandatory consumer protection laws of your country.

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules. Any dispute arising under these Terms will be resolved in the state courts located in Sheridan County, Wyoming, or the federal courts for the District of Wyoming.

If you live in the EU, the UK, or another country whose laws let consumers bring claims in their local courts, you keep that right.
